Listed below are some general guidelines associated with the ongoing protests and curfews that have impacted several metropolitan areas as provided to the RSA from WorkSmart: Employers should be in frequent communication with their employees with a message that employee safety is your number one priority. It’s recommended that any location in an area with a curfew should be closed an hour before the curfew begins so that employees have time to safely leave the area. Any employee who needs additional time due to the need to use public transportation, walk, or bike to work, for example, should be allowed to leave earlier without application of attendance penalty/discipline. This also applies to employees who arrive late because buses aren’t running early in the morning. This type of leniency can also apply to employees who live in areas with curfews but work in areas without curfews, in the event that they need to arrive late or leave work early. Emergency and non-emergency numbers for the police should be provided to employees, especially to the leaders in your organization. Employees should call the police immediately if their safety is threatened, and they should not engage with anyone who is behaving violently. Determine whether non-exempt employees will be paid for hours missed due to the curfew and communicate that to your employees. Follow all applicable state laws before impacting employee pay. Employers may want to develop a system for escorting employees to their cars depending on the parking situation at your organization. Remind your employees that COVID-19 remains active and they should continue to follow the recommended CDC guidelines, social distancing, proper hygiene, etc.
